The plaintiff is Zhao Shui Liang, the original shareholder of Lensing Coal Industry (holding 30%) and deputy chairman and general manager.

In 2010, in accordance with the spirit of the state policy, Lensing coal industry reform, 70% shareholding transfer to Shandong coal shipping group Shoshua subsidiary (Jinxiang Energy State-owned shares). after the reform, the company is actually controlled by the major shareholders affiliates, the original coal sales are monopolized, the sale of coal funds is out of circulation; Zhao Shui Lens shareholding transfer funds are paid by Lensing coal industry to the associated company for high interest; large shareholders have not held a shareholders' meeting for a long time, the relevant documents for Zhao Shui Lens signature, the rights and interests of small shareholders continue to be infringed.

In the substance, the case involves the management of state-owned enterprises to cover up the issue of abuse of power and corruption, and to use criminal means to fight retaliation against private small shareholders.

First, Zhao Shuling case, after the investigation of the police at the two levels of Pearl and Shouji, was found not to constitute a crime, and Yuan Xiaobo still violated the law to designate jurisdiction, ordered the public security Bureau of the right Yuan County to restart the investigation.

After the major shareholders of Lensing coal industry the case to the Pearl District police, the review determined that it was an economic dispute, and did not file the case.

Violation of the law and designated jurisdiction: In the case of two-level police acceptance and denial of Zhao Xu Liang's involvement in the crime, Yuan Xiaobo violated the provisions of Article 21 of the Procedure for the handling of criminal cases by the public security organs and designated a non-jurisdictional detective office of the right Yuan County Bureau.

The case has not been investigated first, follow-up procedures: Zhao Shui Lian's related charges were formally filed in June and July 2022, but the Right Yuan County Bureau had already conducted the investigation in April, and the seizure of Song Redley and Song Red Xia's property was also covered by pre-checking and subsidizing procedures.

Unlawful seizure of the property of outsiders: Intellectual disabled outsiders Song Red Xia (Zhao Shui Lun's eldest daughter) are listed as "crime suspects", and their property is unlawfully seized.

Hiding Key Evidence: On July 12, 2022, Lensing Coal Industry handed over 196 copies of the 2018 sales report, according to which the Right Yuan County Bureau commissioned the audit and issued a report, but did not transfer to the prosecution law, deliberately hiding key evidence.

Supplementary investigation has been severely exceeded: on June 12, 1924, the Shōjiang Central Court issued a re-trial in violation of the procedure, designated the Shōjiang District Court for trial, and the Right Yuan County Court suspended the trial on July 3, but the Shōjiang County Bureau's compensatory investigation continued, violating the provisions that compensatory investigation may not exceed the January deadline.

* Third, the judgment overturned the malicious nature of the original trial, demonstrating that this case is indeed involved in the economic dispute by criminal means.

On June 15, 2026, the Sohos District Court resumed the judgment, rejecting the core claims of this indictment:

The judgment reiterated that Zhao Shaolin's behavior is to resolve civil economic disputes, subjectively advocate personal rights and interests or pressure, do not suppress the intention of the masses, does not conform to the "evil forces" standards, and coincides completely with the defense claims of "shareholder disputes, not evil".

The sentence and fine were greatly reduced: Zhao Shuling was sentenced to six years from the original sentence of twelve years, and the fine was reduced from 53 thousand yuan to 30 thousand yuan; the period of sentence for the defendants in the entire case was reduced.

The total reduction in the amount of charges: the original trial determined that the compensation loss was more than 2.23 billion yuan, the re-audit was reduced to more than 17 million yuan; the accusations of occupation of office and the loss of coal harvesting throughout the year were not identified.

The re-trial of evil, reduced punishment, and reduced damage, demonstrated two points: First, this case has not been evil since the beginning, the original nature of the trial is due to the violation of the jurisdiction and investigation; Second, Yuan Xiaobo pointed out that the violation of the case, the right Yuan County Bureau of the illegal investigation, is the direct cause of Zhao Shui Liang and others for a long time being guilty.

Article 5 of the "Opinions on Several Issues Concerning the Handling of Criminal Cases of Evil Forces" stipulates that even illegal crimes caused by legal debt disputes and other events shall not be dealt with by evil forces.
