Visitors "been mentally ill": Ding's military four years of "seeking evil" road

There is a saying in society that the ultimate destination of visitors is not a psychiatric hospital, but a prison.

This is, of course, one-sided, extreme, stereotypical, and does not represent the overall status quo of our country's work.

But Wuhan visited the people's building soldiers, both went to the psychiatric department ( "seeing" another visitor), and entered the detention center.

In September 2021, the Wuhan woman Chen Zheng, who was also a visitor, was sent to the psychiatric department of the hospital after a letter visit; several group members went to "rescuing", and were sentenced to administrative punishment of "disrupting the order of the unit" for warning or detention.

01 Visitors sent to a psychiatrist

The whole incident was due to a " sudden disconnection" of a Wuhan visitor Chen Zhen.

“Street staff” also claimed that Chen frequently sang late at night in his home, often complained by neighbors, and frequently harassed staff at night.

More than two people headed to the hospital for rescue

Chen Zhen was sent to the psychiatric department of the hospital and the news was passed to some WeChat groups, many of whom were the same as "visitors".

Several members of the group believe that Chen Jin has no “mental illness”. someone called the police, and others went to the hospital to try to “rescue” Chen Jin.

On the afternoon of October 2, 2021, several group friends clashed with security in the hospital.

After the incident, the police took several people away from the scene of the investigation, and seven people were warned and three were detained.

The relevant "Administrative Punishment Decision" made by the Han Yang District Public Security Branch showed that the relevant personnel were "visited" by Chen and Jin, and were blocked by the hospital, which caused the work of the hospital not to be carried out normally.

Someone beat hospital security personnel who came to deter, and someone damaged security cell phones.

The author noted that on the afternoon of the day of the conflict, Chen Zheng Jin handled the procedure for exit from the hospital and left the psychiatric department of Han Yang Hospital.

After leaving the hospital, Chen Jin had the case of "forced dispatch to a psychiatric clinic and restriction of personal freedom", but the police did not file the case.

03 Arrested 37 days after prosecution by the Public Security Bureau

On the day of the conflict with the hospital security, Ding was not on the scene, but Ding also did a few things in the process of "rescuing the group of friends who were mentally ill."

These things made him a criminal perpetrator and suspect who "disrupted the order of the unit" in the eyes of the police.

According to the official statement, on October 1, 2021, and on the second day, Ding Zhen soldier in several WeChat groups released information such as "Chen Zhen has been determined to be detained in the psychiatric clinic at the Han Yang Hospital, and hopefully friends will come to solidarity" and "to rescue Chen Zhen, to take action".

Ding's actions were thought to be "inciting" others to gather at the hospital. Officials also confirmed that Ding's soldiers went to the hospital for two days.

On November 5, 2021, Ding was sentenced to an administrative penalty of "ten days of detention" by the Hanyang branch of the Wuhan Municipal Public Security Bureau.

In response to the administrative punishment of the police, Ding expressed disobedience, and subsequently applied for administrative reconsideration and initiated administrative lawsuits.

On February 27, 2022, the day after prosecution of the Public Security Bureau and payment of the acceptance fee of the case, Ding was prosecuted by his prosecution object, the Han Yang Branch, on suspicion of "provocation and eviction" criminal case.

At the time, "because of the outbreak, it was not possible to arrest," Ding was taken into custody. About six months later, on September 27, 2022, Ding was executed in criminal custody.

This time, Ding was detained for 37 days. Until November 2, 2022, the Han Yang District Prosecutor’s Office made a decision not to approve the arrest, and Ding was released.

The reason for the non-arrest by the Han Yang District Prosecutor's Office is that Ding Zhen soldier is suspected of "provocation and infestation" crime facts are unclear and evidence is insufficient.

04 Application for State compensation refused

After the prosecutor's office did not approve the arrest, the Han Yang branch continued to take compulsory measures on Ding's building soldiers to "monitor the residence".

Half a year later, on May 3, 2023, all compulsory measures were lifted for Ding. Curiously, Ding has not yet received a decision to withdraw.

This means that the Denguan soldiers are still "criminal suspects" at the legal level.

While waiting hard for the decision to withdraw the case, Ding has been applying for state compensation from relevant departments.

He alleged that he was detained for 37 days by the police for "unlawful" criminal detention, 180 days of surveillance detention, and claimed 200,000 yuan.

According to the relevant provisions of the Criminal Procedure Law, the public security organs may pre-arrest current prisoners or major suspects.

Ding's acts suspected of provocation may be previously detained;

Police proceedings are lawful, and they are released immediately after their arrest is not approved by the prosecutor's office, and there is no violation of their personal rights.

After the police refused to pay compensation, Ding Chang Soldiers applied to the Wuhan Senate to make a decision on compensation.

The Wuhan Senate Compensation Commission also believes that the police's measures of detention against Ding Jian soldier meet the conditions and procedures of the Criminal Procedure Law and there are no violations of law.

He believes that there is no evidence to prove that he constitutes a “crime of provocation,” he is thus imprisoned for 37 days, no one needs to be held accountable for this.
